1. Who we are and acceptance of these Terms

bellamelia.com (the "Store") is operated by BellAmelia ("BellAmelia", "we", "us"). Contact: hello@bellamelia.com.

By visiting the Store or placing an order, you agree to these Terms of Service ("Terms") and to the policies referenced in them: our Privacy Policy, Shipping Policy and Refund & Return Policy. If you do not agree, please do not use the Store. You must be at least 18 years old, or the age of majority in your state, to place an order.

The Store is hosted on Shopify. Shopify is our service provider and is not the seller of the products.

2. Products and cosmetic use

  • Unless a product page states otherwise, products sold on the Store are intended as cosmetics or beauty/personal-care accessories, meant to cleanse, beautify or improve the appearance of the skin and lips, and are not intended to diagnose, treat, cure, mitigate or prevent any disease or medical condition. If a product is regulated differently (for example, an over-the-counter drug), its product page and label will say so and include the required information.
  • Information on the Store, in our emails and on our social media is provided for general information only and is not medical advice. Consult a dermatologist or other healthcare professional if you have a skin condition, allergies, are pregnant or breastfeeding, are under medical treatment, or have any concern before use.
  • Patch test before first use: apply a small amount of the product to a small area of skin, such as the inner forearm or behind the ear, and wait 24โ€“48 hours. Do not use the product if redness, itching, burning, swelling or other irritation occurs. Stop using any product immediately if irritation develops, and seek medical attention if symptoms are severe or persist.
  • Always read the full ingredient list and instructions on the product label and product page before use. Avoid contact with eyes unless the product is intended for the eye area, and do not apply to broken, irritated or infected skin unless the label says otherwise. Keep out of reach of children.
  • Results vary from person to person. Images, including customer photos, show individual experiences and are not a promise of results.
  • BellAmelia is the brand. Our products are made and distributed for the US by our manufacturing partner, Nord Beauty SIA (Latvia), which is the US Responsible Person for the products under the Modernization of Cosmetics Regulation Act (MoCRA). The label on each product identifies the Responsible Person and the country of origin.
  • Product colors, packaging and labels may vary slightly from the images shown, and formulas or packaging may be updated; the label on the product you receive prevails.
  • Product safety reports: if you experience an adverse reaction, contact us at hello@bellamelia.com at any time (see our Refund & Return Policy, Section 4).

3. Orders, pricing and payment

  • All prices are in US dollars (USD).
  • Your order is an offer to buy. We accept it when we ship the product. We may refuse or cancel an order (for example, for suspected fraud, stock unavailability, or an obvious pricing or description error); if we cancel after you have paid, we will refund you in full.
  • We try to display prices and product information accurately. If we discover a pricing error, we will contact you and give you the option to confirm the order at the correct price or cancel it for a full refund.
  • Payments are processed by third-party payment processors. By submitting payment you confirm you are authorized to use the payment method.
  • Applicable US sales taxes are calculated at checkout. Orders are shipped DDP, so no duties or import fees are charged to you on delivery (see our Shipping Policy).
  • "Compare at" or reference prices, when shown, reflect a genuine former or prevailing price as described on the page.
  • You may cancel your order free of charge until it has shipped (see our Shipping Policy).

4. Shipping, returns and refunds

Delivery is governed by our Shipping Policy and returns and refunds by our Refund & Return Policy, which form part of these Terms. In summary: our products are made and distributed for the US by our manufacturing partner and shipped DDP from its warehouse in the United States, only to the 48 contiguous US states, with an estimated 4โ€“7 business days from order to delivery; Standard Shipping is $7.95, or free on orders of $65 or more. We do not accept returns for change of mind; damaged, defective, incorrect or missing items reported within 14 days of delivery with photos are reshipped or refunded with no need to send anything back. Risk of loss passes to you upon delivery to the shipping address you provided.

5. Reviews, comments and content you submit

If you submit a review, photo or other content, it must be truthful, reflect your genuine experience with the product, and must not be defamatory, infringing, or unlawful. You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce and display it in connection with the Store and our marketing, crediting you by the display name you provided. We do not edit reviews to change their meaning, we do not suppress negative reviews because they are negative, and we clearly disclose when a reviewer received a free product or other incentive. We may remove content that violates these Terms.

6. Intellectual property

The content of the Store (including text, graphics, photos, images and page design) is owned by or licensed to us or our suppliers and is protected by intellectual-property laws. You may not copy, reproduce or use it for commercial purposes without our prior written permission. The BellAmelia name and logo are used by us as our brand. Other names and brands belong to their respective owners.

7. Acceptable use

You agree not to use the Store for any unlawful purpose; to interfere with its security or operation; to submit false information or fraudulent orders; to resell products in violation of law; or to use automated tools to scrape the Store.

8. Third-party links and services

The Store may link to third-party websites or services (for example, carriers' tracking pages or social media). We are not responsible for their content or practices.

9. Disclaimer of warranties

Except as expressly stated in these Terms or required by law, the Store and products are provided "as is" and "as available". To the fullest extent permitted by applicable law, we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you. Nothing in these Terms limits your rights under our Refund & Return Policy or under mandatory consumer law.

10. Limitation of liability

To the fullest extent permitted by applicable law, BellAmelia and its owners, suppliers and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising out of or relating to your use of the Store or products. Our total liability for any claim relating to a product or order is limited to the amount you paid for that product or order. These limitations do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, fraud, or willful misconduct, or to rights you have under mandatory consumer protection laws.

11. Indemnification

To the extent permitted by law, you agree to indemnify BellAmelia against claims arising from your breach of these Terms or misuse of the Store or products (for example, using a product contrary to its label instructions).

12. Governing law and disputes

  • These Terms are governed by the laws of Portugal, without prejudice to any mandatory consumer protection laws of your US state of residence that cannot be waived by agreement.
  • Any dispute will be submitted to the courts of Lisbon, Portugal. However, you may instead bring an individual claim in the small-claims court of the county where you live, if your claim qualifies.
  • Before filing a claim, please contact us at hello@bellamelia.com so we can try to resolve it informally; we will try to do so within 30 days. This does not prevent you from going to court or contacting a consumer protection authority.

13. Changes to these Terms

We may update these Terms from time to time. The version posted at the time of your order applies to that order.

14. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies referenced, are the entire agreement between you and us regarding the Store. These Terms are written in English; any translation is for convenience only.
